After a lot of issue, the Chinese mobile phone maker Xiaomi obtained a partial relieve
from the Delhi Court with a Division Bench which allows Xiaomi to sell its cell phones, based on the chip acquired from Qualcomm Incorporated.  Furthermore, the court directed to Xiaomi to send payment for all cell phones imported in India, which will be placed before the higher court and stored in fixed deposit for three months while the case is on process and being heard.

A week ago, single judge bench of the court had controlled all sales of Xiaomi phones in India, upon a complaint by a tech giant Ericsson Telefonaktibolaget, which had mentioned the Chinese start up had breached its patent by not paying to get a permit to use its technology.


Throughout the hearing before the court of Justice Pradeep Nandrajog and Justice R K Gauba, represented by Senior Advocate Kapil Sibal, mentioned this had bought phone chipsets from Qualcomm, which holds the patent license for the eight patents for 3G technology that are under consideration in this case.


According to Xiaomi under the terms of agreement involving Qualcomm and Xiaomi, this chipset installed in Xiaomi Redmi 1S, Xiaomi Mi3 and Redmi Note 4G had been licensed as they had been based on Qualcomm technology. The firm also presented copies of communication with Qualcomm to assist their debate that they had not infringed the patent. This Redmi Note 3G and some other models even so tend to be based on the chipsets sourced from Mediatek, which does not have license to sell as a licensee of Ericsson.

High Court has issued pro  tem orders permitting Xiaomi to import and sell Qualcomm based mobile phones India till next date of hearing. Court has also straight to Xiaomi to submit the details of invoices of the purchase of the said chipset from Qualcomm and information of sale of Qualcomm based phones in India. Additionally, bench has directed Xiaomi to deposit Rs 100 for every unit shipped in India.

The price tag of Redmi Note 4G is Rs 9,999.
