After a lot of issue, the Chinese mobile phone maker Xiaomi obtained a partial relieve
from the Delhi Court with a Division Bench which allows Xiaomi to sell its cell phones, based on the chip acquired from Qualcomm Incorporated.  Furthermore, the court directed to Xiaomi to send payment for all cell phones imported in India, which will be placed before the higher court and stored in fixed deposit for three months while the case is on process and being heard.

A week ago, single judge bench of the court had controlled all sales of Xiaomi phones in India, upon a complaint by a tech giant Ericsson Telefonaktibolaget, which had mentioned the Chinese start up had breached its patent by not paying to get a permit to use its technology.


Throughout the hearing before the court of Justice Pradeep Nandrajog and Justice R K Gauba, represented by Senior Advocate Kapil Sibal, mentioned this had bought phone chipsets from Qualcomm, which holds the patent license for the eight patents for 3G technology that are under consideration in this case.
